Fuse Terms of Use

These terms apply to everyone who uses the fitness app Fuse ("Fuse", "we", "us", "our"). By creating an account or using the app, you agree to them. We have tried to write them as clearly as possible, without unnecessary legal jargon.

1. Who may use Fuse

  • You must be at least 16 years old. If you are younger, you may only use Fuse with the consent of a parent or legal guardian.
  • You create an account with your own details and keep them accurate.
  • You are responsible for what happens with your account. Keep your password safe and do not share it.
  • One person, one account. Do not create an account on someone else's behalf and do not pretend to be someone else.

If you suspect that someone else has access to your account, let us know at the address in section 11.


2. What Fuse is, and what it is not

Fuse is a tool for tracking your workouts, your nutrition and your activities, and for sharing them with friends.

Fuse does not give medical advice. The calorie and macro goals, the BMI display, the workout suggestions and every other number in the app are general calculations based on what you enter. They are not a diagnosis, not a treatment and not a substitute for a doctor, dietitian or physiotherapist. If you are about to change your nutrition or your training, if you are unsure about an injury, if you are pregnant or if you have a medical condition, talk to a professional. You exercise at your own risk.

The nutrition values come partly from a public database that is filled in by volunteers. They can be incorrect or incomplete. Always check important values yourself on the packaging.


3. What you share in Fuse

Everything you put in Fuse stays yours: your workouts, your photos, your comments, your messages. We do not become the owner of your material.

To make the app work, you do give us permission to store that material and show it to the people who are allowed to see it according to your own settings. If you set a workout to private, we show it to no one. If you set it to public, everyone in the app can see it. That choice is yours and you can change it.

If you delete something, we remove it. What others have already seen or saved, we cannot take back.

You are responsible for what you post. Only post material that is yours or that you are allowed to use.


4. Rules of conduct

Fuse is a place to help each other get further. That is why there are limits, and we enforce them.

Not allowed, without exception:

  • Hurting, bullying, threatening, intimidating or harassing other users
  • Hateful expressions: anything that attacks or demeans people on the basis of origin, skin color, religion, sex, sexual orientation, disability, age or any other personal characteristic
  • Sexually explicit material, nudity and anything sexual in nature directed at minors
  • Glorifying violence, calling for violence or sharing violent imagery
  • Encouraging self-harm, suicide or an eating disorder. Fuse is about being healthy, not about hurting yourself
  • Posting other people's material without having the right to do so, or sharing other people's personal data without their permission
  • Pretending to be someone else, or creating a fake account
  • Advertising, spam, chain messages, selling products or services, and recruiting people for something else
  • Misusing the app or our servers: breaking in, overloading them, scraping them automatically, bypassing security, or trying to reach other people's data
  • Anything that breaks the law

Zero tolerance. We have zero tolerance for objectionable content and abusive users. Material that breaks these rules is removed as soon as we see it or it is reported to us. Anyone who posts it anyway can lose their account, immediately and without warning if the case is serious enough.


5. Reporting and blocking

If you come across something that crosses the line, we do not have to discover it ourselves.

  • Blocking. You can block any user. The two of you then disappear from each other's app. You can see who you have blocked under Settings, at Privacy and safety, and you can undo it there as well.
  • Reporting. You can report a user, a workout, an activity, a comment, a shared product, a group and a group message. Profiles, workouts and activities have a menu in the top right for this; next to someone else's comment there are three dots, with report and block. We keep a copy of what you report, so a report still counts if the original is removed quickly.

What we do with reports: we review every report and handle it within 24 hours. If the material turns out to break section 4, we remove it and take action against the account that posted it. That can be a warning, the removal of material, or the closure of the account.

If it is an emergency or a criminal matter, call your local emergency number (112 in the Netherlands) or report it to the police. We are not an emergency service.


6. What we may do

We may remove material that breaks these terms or the law, and we may suspend or close an account if someone does not follow them. Where that is reasonable, we will tell you why.

We may change the app, add features and remove features. For significant changes we will let you know in the app.


7. Availability

We do our best to keep Fuse running, but we do not promise that the app is always available or always works without errors. Maintenance, outages and problems at our suppliers can make the app temporarily unavailable.

Make sure that important data is not stored only in Fuse.


8. Liability

Fuse is provided as it is. To the extent permitted by law, we are not liable for damage arising from the use of the app, from its unavailability, from incorrect nutrition or training data, or from what other users post or do.

Nothing stated here ever limits our liability in cases of intent or deliberate recklessness on our part, and nothing stated here ever limits the rights you have as a consumer under mandatory law.


9. Stopping

You can stop at any time. You delete your account yourself in the app, under Settings. We then delete your data as described in the privacy policy.

We may close your account if you break these terms, if we are legally required to do so, or if we stop running Fuse. In that last case we will let you know well in advance so that you can request your data.


10. Changes to these terms

We may update these terms, for example when the app changes or when the rules require it. The date at the top shows when we last did so. For significant changes we will let you know in the app. If you keep using Fuse after that, the new terms apply. If you do not agree with them, you can delete your account.


11. Governing law and contact

These terms are governed by the laws of the Netherlands. Disputes are submitted to the competent court in the Netherlands, unless the law designates another court.
